The Social Security Appeals process is stressful as well as lengthy – approximately 2 years. Also, the requirements for winning Social Security Disability (SSD) and Supplemental Security Income (SSI) benefits are very stringent and complicated. There are four (4) appeals that are available to you:
1. Reconsideration: The review of the initial denial of your claim.
2. Administrative Law Judge Hearing: The review of the Reconsideration decision by an Administrative Law Judge in the Office of Hearings and Appeals in your area.
3. Appeals Council Review: The review of the Administrative Law Judge's decision by the Appeals Council.
4. Federal Court Civil Action: The review of the Appeal Council's decision, or their denial of your request for review, by the U. S. District Court for the area where you live.
HOW TO REQUEST AN APPEAL: Your request must be in writing. We will help you fill out and timely submit your Appeal forms.
YOU HAVE 60 DAYS TO APPEAL: You have 60 days after you receive the notice of your denial to ask for an Appeal. If you do not appeal on time, your case may be dismissed. This means that you may have to reapply for benefits and start the process all over again. So time is of the essence.
WHERE AND WHEN IS YOUR HEARING HELD: The Administrative Law Judge usually holds the hearing within 75 miles of your home, approximately 1 year after you request a hearing.
THE ADMINISTRATIVE LAW JUDGE HEARING: You will benefit from our extensive experience and high success rate with Administrative Law Judge Hearings. You may have witnesses testify on your behalf at the hearing. If your witnesses cannot come to the hearing and testify, they can give us their written statements that we can submit to the Judge before your hearing. You and the witnesses must answer all questions under oath. The hearing is informal but it is recorded. In addition, the Administrative Law Judge usually has a Vocational Expert come to the hearing to testify about your disabilities and their impact on your ability to work - namely whether or not you can perform sustained work on a regular and continuing basis - meaning 8 hours a day, 5 days a week, for 50 weeks out of a year.
AFTER THE HEARING: The Administrative Law Judge will review all the evidence and issue his/her written decision approximately 1 to 3 months after the hearing. The decision will be favorable, partially favorable, or unfavorable and it will be mailed to you. If it is favorable, your benefits will start approximately 1 to 3 months after your receipt of the Judge’s decision.
